快遞暫行條例征求意見：泄露用戶信息或被吊銷經(jīng)營許證

7月24日，國務院法制辦公室官網(wǎng)發(fā)出《快遞暫行條例》（征求意見稿）。《征求意見稿》中規(guī)定，地方各級人民政府應當確保政府相關行為符合公平競爭要求和相關法律法規(guī)，維護快遞業(yè)競爭秩序，不得出臺違反公平競爭，可能造成地區(qū)封鎖和行業(yè)壟斷的政策措施。

征求意見稿第十二條規(guī)定，縣級以上地方人民政府公安、交通運輸?shù)炔块T和郵政管理部門應當加強協(xié)調配合，建立健全快遞運輸保障機制，依法保障快遞服務車輛通行和臨時停靠的權利，不得禁止快遞服務車輛依法通行。

同時，征求意見稿規(guī)定，經(jīng)營快遞業(yè)務的企業(yè)停止經(jīng)營的，應當提前10日向社會公告，書面告知郵政管理部門，交回快遞業(yè)務經(jīng)營許可證，并依法妥善處理尚未投遞的快件。

此外，意見稿第四十二條還提及，若經(jīng)營快遞業(yè)務的企業(yè)有違反條令行為之一的，由郵政管理部門責令改正，沒收違法所得，并處1萬元以上5萬元以下的罰款；情節(jié)嚴重的，并處5萬元以上10萬元以下的罰款，并可以責令停業(yè)整頓直至吊銷其快遞業(yè)務經(jīng)營許可證。
